Terms and Conditions for Digital Products

These Terms and Conditions for Digital Products (“Digital Terms”) apply exclusively to downloadable products purchased from ETC Montessori through etcmontessorionline.com. Digital products include, but are not limited to, printable PDF materials, curriculum files, training manuals, charts, timelines, cards, guides, and other electronically delivered content.
By purchasing, accessing, or downloading a digital product, you acknowledge that you have read, understood, and agreed to these Digital Terms. If you are purchasing on behalf of a school, homeschool co-op, organization, or other group, you represent that you are authorized to accept these terms on its behalf.
Important Purchase Information
Before completing your order, please note:
- Digital products are licensed, not sold.
- All digital-product sales are final, non-returnable, and non-refundable.
- Download links remain active for five consecutive calendar days.
- Each purchased file may be downloaded no more than two times during that five-day period.
- Expired download links will not be reactivated. The product must be repurchased to obtain a new link.
- Individual Licenses may not be shared with schools, co-ops, classrooms, organizations, or other households.
- Schools, homeschool co-ops, and multi-family homeschool groups must purchase an Extended License.
- Purchase orders are not accepted as payment for digital products. Digital access is not provided until full payment has been received and cleared.
1. License Grant and Ownership
Purchasing a digital product grants you a limited, non-exclusive, non-transferable, and revocable license to use the product according to the license type selected at checkout.
Your purchase does not transfer ownership of the digital product or its intellectual property rights. ETC Montessori and its licensors retain all copyrights, trademarks, designs, illustrations, text, layouts, and other proprietary rights associated with the product.
The digital file, its contents, and any copies made from it remain protected by United States and international copyright laws.
2. Individual License
An Individual License is intended exclusively for an individual homeschool purchaser using the material within one household.
Under an Individual License, the purchaser may:
- Download and save the file for personal educational use.
- Use the material with children residing within the purchaser’s household.
- Print a reasonable number of copies for use within that household.
- Maintain a personal backup copy on a secure device or storage account controlled by the purchaser.
An Individual License does not permit the purchaser to:
- Share the digital file with another household, family, teacher, tutor, classroom, school, co-op, organization, or program.
- Use the material as part of a multi-family homeschool group or co-op.
- Place the file on a school, classroom, organization, or shared network.
- Email, upload, transfer, or otherwise distribute the file to other individuals.
- Purchase the material personally and then use or distribute it within a school or other organization.
A teacher, administrator, school employee, or co-op leader purchasing a product for institutional or group use must select an Extended License.
3. Extended License
An Extended License is required when a digital product will be used by a school, homeschool co-op, multi-family homeschool group, or similar educational organization.
An Extended License permits internal educational use by:
- One school located within one physical building.
- One homeschool co-op.
- One identified multi-family homeschool group.
- Authorized teachers, staff members, or participating households associated with the licensed school or group.
Authorized users may access and reproduce the material only as reasonably necessary for educational use within the licensed school, co-op, or group. The purchaser is responsible for ensuring that everyone receiving access follows these Digital Terms.
An Extended License is not a district-wide, organization-wide, franchise-wide, or multi-campus license. Each physical school building, separate campus, branch, co-op, or independently operating group must purchase its own Extended License.
For example, if a school district intends to use a digital product in five school buildings, five Extended Licenses must be purchased—one for each physical school building.
An Extended License does not permit sharing with unrelated schools, other campuses, outside organizations, former group members, or individuals who are not part of the licensed school or group.
4. Restrictions Applicable to All Licenses
Regardless of the license purchased, you may not:
- Sell, resell, rent, sublicense, or commercially redistribute a digital product.
- Post or upload the file to a public or unrestricted website, shared drive, social-media platform, file-sharing service, or online marketplace.
- Distribute the file through email lists, public classroom websites, or unrestricted learning-management systems.
- Remove, obscure, or alter copyright notices, trademarks, watermarks, or ownership information.
- reproduce or adapt the product to create materials for sale or distribution.
- Claim any portion of the product as your own original work.
- Use the product to create a competing commercial product.
- Transfer the license to another person, household, school, co-op, or organization.
- Exceed the number or type of authorized users permitted by the selected license.
Limited classroom annotations or adaptations may be made for authorized educational use, but those adaptations may not be sold, published, publicly posted, or distributed beyond the scope of the purchased license.
5. Download Availability and Expiration
For orders paid electronically, download access generally begins after checkout is successfully completed, payment is approved, and the order status is changed to Complete.
Once access is activated:
- The download link remains available for five consecutive calendar days.
- Each purchased file may be downloaded up to two times during that period.
- The link expires automatically after five calendar days or after the permitted downloads have been used, whichever occurs first.
- Download access cannot be paused, extended, renewed, or restarted.
- Expired links will not be reactivated or replaced.
- If access expires or both permitted downloads are used, the customer must repurchase the product.
Customers are responsible for downloading files promptly and saving them to a secure location. ETC Montessori is not responsible for files that are deleted, misplaced, damaged, overwritten, or otherwise lost after download.
The expiration of a download link does not terminate a properly purchased license for a file that was successfully downloaded and retained. However, ETC Montessori is not obligated to store, resend, or replace the file after the access period expires.
6. Digital Products Are Non-Refundable
Because digital products provide access to copyrighted content that cannot be physically returned, all completed digital-product sales are final, non-returnable, and non-refundable, except where otherwise required by applicable law.
Refunds or credits will not be issued because:
- The customer did not download the product within the five-day period.
- The customer used both permitted downloads.
- The customer no longer wants or needs the product.
- The customer purchased the wrong product or selected the wrong license.
- The customer already owns the same or a similar product.
- The customer’s device, software, printer, network, or security settings are incompatible with the file.
- The customer expected a physical product instead of a digital download.
- The customer misplaced or deleted the downloaded file.
- The customer experiences differences in printer color, scale, margins, or output quality.
Customers should carefully review the product description, license selection, system requirements, page count, file format, and included materials before purchasing.
A verified duplicate charge or billing error may be reviewed by ETC Montessori. Such review does not change the general no-refund policy.
7. Purchase Orders and Digital Products
ETC Montessori does not accept purchase orders as payment for digital products. A purchase order is not payment and does not create a right to access downloadable content.
If an order containing digital products is submitted or designated as being paid through a purchase order:
- The order will remain in Pending or Processing status.
- No download links will be activated while payment remains outstanding.

The payment should include the applicable order number or sufficient information for ETC Montessori to identify the order.
After payment has been received by our office and the check has cleared, ETC Montessori will change the order status to Complete. Download access will then be activated for the end user.
The five-day download period does not begin when the purchase order is submitted. It begins when cleared payment has been confirmed, the order has been marked Complete, and the download link has been activated.
Once activated, the standard five-day period and two-download limit apply. Expired links will not be reactivated, and the product must be repurchased if the customer does not complete the download within the permitted period.
8. Payment, Pricing, and Order Acceptance
All prices are shown in the currency displayed during checkout. Customers are responsible for applicable taxes, processing charges, and other amounts shown before the order is submitted.
ETC Montessori reserves the right to:
- Refuse or cancel an order before digital access is provided.
- Correct pricing, product-description, or technical errors.
- Request additional information to verify a payment or purchaser.
- Withhold digital access until payment has been approved and fully cleared.
- Cancel fraudulent, unauthorized, or improperly submitted orders.
If ETC Montessori cancels a paid order before digital access is provided, the amount collected for the canceled product will be returned using the original payment method.
9. Customer Accounts and Email Addresses
Customers are responsible for providing a valid email address and accurate account information. ETC Montessori is not responsible for download notices or order communications that are not received because of:
- An incorrect email address.
- Spam or junk-mail filtering.
- A full or inaccessible mailbox.
- School or workplace security filters.
- Changes to the customer’s account or contact information.
Customers are responsible for protecting their account credentials and download links from unauthorized access. Activity occurring through the purchaser’s account or download link may be treated as activity authorized by the purchaser.
10. Technical Requirements
Digital products may require current PDF-reading software, a compatible device, internet access, sufficient storage space, and appropriate printing equipment.
Customers are responsible for confirming that they have the technology required to download, open, save, and print the purchased product. Differences in devices, software, monitors, printers, paper, ink, scaling, and print settings may affect the appearance of the final materials and do not constitute a product defect.
If a downloaded file appears to be corrupted or incomplete, the customer should contact ETC Montessori promptly and before the download period expires.
11. Educational Use and Product Updates
ETC Montessori’s digital products are educational resources. No product guarantees a particular academic result, student outcome, accreditation decision, regulatory approval, or compliance determination unless expressly stated in the product description.
Teachers, parents, guides, and administrators remain responsible for determining whether a product is appropriate for their learners and educational setting.
Products are provided in the edition available at the time of purchase. A purchase does not include automatic access to future editions, revisions, corrections, additions, or replacement files. Editorial or typographical corrections may be incorporated into future editions without creating an obligation to provide updated files to previous purchasers.
12. Copyright Enforcement and License Violations
Unauthorized copying, sharing, posting, distribution, or reproduction may cause financial and intellectual-property harm to ETC Montessori and its licensors.
ETC Montessori may suspend or terminate a license when it reasonably believes that the purchaser or an authorized user has violated these Digital Terms. Upon termination, all use of the product must stop, and all unauthorized digital and printed copies must be deleted or destroyed.
Termination for a license violation does not entitle the purchaser to a refund.
The purchaser is responsible for license violations committed by individuals to whom the purchaser provides access.
13. Disclaimer of Warranties
To the fullest extent permitted by law, digital products and download services are provided “as is” and “as available.”
ETC Montessori disclaims all express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
ETC Montessori does not warrant that the website, checkout process, customer account, download system, or digital files will always be uninterrupted, error-free, or compatible with every device, program, network, or printer.
Nothing in these Digital Terms excludes a warranty or consumer right that cannot legally be excluded.
14. Limitation of Liability
To the fullest extent permitted by law, ETC Montessori will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the purchase, download, inability to download, printing, use, or misuse of a digital product.
This includes loss of data, loss of files, printing expenses, technology expenses, loss of business, loss of educational time, or costs associated with replacing an expired or deleted file.
To the extent liability cannot be excluded, ETC Montessori’s total liability relating to a digital product will not exceed the amount paid for the specific digital product giving rise to the claim.
These limitations do not apply to liabilities that cannot legally be limited or excluded.
15. Privacy
Information collected during checkout, account registration, payment processing, and customer support is handled according to ETC Montessori’s Privacy Policy.
Customers must not use a digital product or its associated services to collect, disclose, or distribute another person’s personal information unlawfully.
16. Governing Law
These Digital Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Where legally permitted, disputes arising from these Digital Terms or the purchase of a digital product will be brought in the state or federal courts serving Harris County, Texas.
Nothing in this section limits any mandatory consumer rights or jurisdictional protections that apply under applicable law.
17. Changes to These Terms
ETC Montessori may revise these Digital Terms periodically. Updated terms become effective when posted unless a later date is stated.
Unless required by law, changes will apply prospectively. The version in effect when an order is completed will govern that purchase.
18. Severability and Waiver
If any provision of these Digital Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
A failure by ETC Montessori to enforce a provision on one occasion does not waive its right to enforce that provision in the future.
19. Entire Agreement
These Digital Terms, the applicable product description, the selected license, and ETC Montessori’s incorporated website policies constitute the agreement governing the purchased digital product.
If a product page or separately signed written license contains terms that are more specific than these Digital Terms, those specific terms will govern that product. Otherwise, these Digital Terms control matters involving digital-product purchases, downloads, refunds, and license use.
