This Copyright, Trademark, and Intellectual Property Policy explains the ownership and permitted use of content, products, trademarks, and other intellectual property made available by ETC Montessori through etcmontessorionline.com and related ETC Montessori websites, services, publications, and digital products.

By accessing the website, purchasing a product, downloading a file, or submitting content to ETC Montessori, you agree to comply with this policy and all applicable product-license terms.

Nothing in this policy limits any use expressly authorized by law. All rights not expressly granted are reserved.

1. Ownership of Website Content

ETC Montessori owns, controls, or has obtained permission to use the content made available through its website and services.

Protected content may include:

• Educational curricula and publications.
• Digital downloadable products.
• Printed materials.
• Training manuals and guides.
• Nomenclature cards and task cards.
• Charts, diagrams, illustrations, and timelines.
• Photographs, videos, audio recordings, and animations.
• Product descriptions and instructional text.
• Research questions, experiments, activities, and answer keys.
• Page layouts, graphic designs, icons, and visual presentations.
• Software, databases, downloadable files, and website code.
• Logos, trademarks, service marks, product names, and slogans.

Unless a different ownership notice appears with particular content, the content is protected by United States and international copyright, trademark, and other intellectual-property laws.

Displaying content on the website does not place that content in the public domain and does not grant visitors ownership or unrestricted permission to use it.

2. ETC Montessori Trademarks

The ETC Montessori name, ETC Montessori logo, ETC logo, associated designs, product-line names, slogans, and other brand identifiers are trademarks, service marks, or registered trademarks owned by or used under authorization from Montessori Connections LLC and ELM Group Management Inc., as applicable.

The symbols ™, SM, and ® may be used to identify trademark rights. The absence of a trademark symbol does not mean that ETC Montessori or the applicable owner has waived its rights.

ETC Montessori trademarks may not be used without prior written authorization in any manner that:

• Suggests sponsorship, approval, certification, affiliation, or endorsement.
• Is likely to confuse customers about the source of products or services.
• Advertises or sells unauthorized copies of ETC Montessori materials.
• Appears in a business name, domain name, social-media account, application name, or marketplace listing.
• Imitates ETC Montessori branding, packaging, trade dress, or website design.
• Disparages, dilutes, or harms the reputation of ETC Montessori or its products.

Any authorized use must follow the written permission and brand-use requirements provided by ETC Montessori.

3. Third-Party Trademarks

Nienhuis Montessori, Educo, Apple, and other third-party names, logos, products, and brands appearing on the website are trademarks or registered trademarks of their respective owners.

Their appearance on the website does not transfer ownership to ETC Montessori. References to third-party products or trademarks do not imply sponsorship or endorsement beyond any authorized distributor, supplier, partnership, or commercial relationship expressly identified by ETC Montessori.

Visitors and purchasers may not copy or use a third party’s trademarks based solely on their appearance on the ETC Montessori website.

4. Limited Permission to Use the Website

ETC Montessori grants visitors limited permission to access and view publicly available website pages for personal, informational, and lawful purposes.

Visitors may:

• View publicly accessible website content through an ordinary web browser.
• Print a limited copy of a public webpage for personal reference.
• Share a standard link directing others to a publicly accessible ETC Montessori webpage.
• Use purchased materials within the scope of the applicable Individual or Extended License.
• Make another use that ETC Montessori has expressly approved in writing.

A link to ETC Montessori must not:

• Suggest that ETC Montessori endorses the linking party.
• Display ETC Montessori content within a frame or copied webpage.
• Bypass checkout, payment, account, or download restrictions.
• Direct users to an unauthorized copy of an ETC Montessori product.
• Use an ETC Montessori logo or trademark without permission.

5. Digital Products and Product Licenses

Purchasing an ETC Montessori digital product grants a limited license to use the product. It does not transfer copyright ownership.

An Individual License is intended for an individual homeschool purchaser using the material within one household.

An Extended License is required for schools, homeschool co-ops, multi-family homeschool groups, and other institutional or group use. Each physical school building must purchase its own Extended License.

Except as expressly permitted by the selected license, purchasers may not reproduce, share, distribute, upload, display, project, or transmit ETC Montessori digital files.

Detailed license requirements are provided in the Digital Product Terms and License Conditions. If this policy conflicts with a product-specific written license, the product-specific written license will govern the permitted use of that product.

6. Prohibited Uses

Except where expressly authorized by a purchased license, written permission, or applicable law, no person or organization may:

• Copy, reproduce, scan, photograph, record, or digitize ETC Montessori content.
• Email or transfer digital files to unauthorized individuals.
• Upload materials to public or unrestricted websites, shared drives, social-media platforms, learning-management systems, or file-sharing services.
• Sell, resell, rent, sublicense, or commercially redistribute ETC Montessori content.
• Use ETC Montessori content to create a competing product or service.
• Translate, modify, adapt, or create derivative products for publication, sale, or distribution.
• Extract illustrations, diagrams, text, or activities for use in another publication.
• Display or project materials outside the scope of the purchased license.
• Remove or alter copyright notices, trademarks, watermarks, credits, or ownership information.
• Use product photographs or descriptions to advertise unauthorized, counterfeit, or competing products.
• Circumvent passwords, download limits, access controls, watermarks, or other technological protections.
• Scrape, harvest, index, or systematically extract website or product content.
• Include ETC Montessori content in a database, content library, digital repository, or commercial resource collection.
• Use ETC Montessori content to train, fine-tune, test, benchmark, or develop an artificial-intelligence or machine-learning system without prior written authorization.
• Claim ETC Montessori content as original work created by another person or organization.

Unauthorized use may result in suspension of website access, termination of a product license, removal from a platform, legal action, or other remedies available under applicable law.

7. Photocopying and Classroom Reproduction

The purchase of a physical or digital publication does not automatically grant unlimited photocopying or reproduction rights.

Photocopying, printing, displaying, projecting, or reproducing materials is permitted only to the extent authorized by:

• The Individual License.
• The Extended License.
• A product-specific written license.
• Written permission from ETC Montessori.
• Applicable law.

A school, district, co-op, organization, or employer may be responsible for unauthorized copying or sharing performed by its employees, contractors, teachers, or authorized users.

Systematic copying to avoid purchasing the correct number or type of licenses is prohibited.

8. Educational Use and Fair Use

The fact that content is used for teaching, scholarship, research, nonprofit activity, or another educational purpose does not automatically make the use lawful or qualify it as fair use.

Fair use is determined case by case based on applicable law and circumstances, including:

• The purpose and character of the use.
• The nature of the copyrighted work.
• The amount and significance of the material used.
• The effect of the use on the market for the original work.

This policy does not restrict a use that is legally protected as fair use or under another applicable copyright exception. However, ETC Montessori cannot determine whether a proposed third-party use qualifies for an exception and cannot provide legal advice.

Anyone uncertain about a proposed use should consult a qualified intellectual-property attorney.

9. Permission Requests

Permission is required before using ETC Montessori content outside the applicable product license.

A permission request should include:

• The requester’s full name and organization.
• Contact information.
• The specific product, image, text, or content requested.
• A copy, screenshot, URL, SKU, or other identifying information.
• The proposed use.
• The number of copies or expected audience.
• Whether the use is commercial or noncommercial.
• The planned publication or distribution method.
• The geographic territory and duration of the proposed use.

Requests should be emailed to legal@edutc.com.

Submitting a request does not grant permission. Permission is effective only when provided in writing by an authorized ETC Montessori representative. Failure to respond to a request does not constitute approval.

ETC Montessori may approve, deny, limit, condition, or charge a licensing fee for a proposed use.

10. Reporting Unauthorized Use of ETC Montessori Content

Suspected unauthorized copying, distribution, resale, marketplace listings, or public posting of ETC Montessori content may be reported to legal@edutc.com.

Reports should include:

• The location or URL of the suspected infringement.
• The name of the person, organization, seller, or account involved, if known.
• The ETC Montessori product or content being copied.
• Screenshots or other supporting information.
• The reporting person’s contact information.

ETC Montessori will evaluate reports and determine the appropriate response. Submitting a report does not create an attorney-client relationship or guarantee that ETC Montessori will take a particular action.

11. User-Submitted Content and Classroom Photographs

Anyone submitting photographs, reviews, videos, lesson examples, testimonials, or other content to ETC Montessori represents that they have the legal right to submit the content.

The submitter must have obtained all necessary:

• Copyright permissions.
• Photographer permissions.
• Trademark permissions.
• Privacy and publicity releases.
• School or organizational approvals.
• Parent or legal-guardian consent for identifiable minors.

Content must not be submitted if it infringes another person’s copyright, trademark, privacy, publicity, or other rights.

When content is submitted for publication or promotional use through a form, campaign, contest, or other process that includes a content license or release, the terms presented during that submission will govern ETC Montessori’s use.

ETC Montessori may remove submitted content at any time and may disclose information when reasonably necessary to address an infringement claim, comply with legal process, or protect legal rights.

12. Respect for Third-Party Intellectual Property

ETC Montessori respects the intellectual-property rights of others and expects website users, customers, contributors, and authorized users to do the same.

If you believe that content hosted or displayed through an ETC Montessori service infringes your copyright, you may submit a written notification under the Digital Millennium Copyright Act (“DMCA”).

The DMCA process applies to copyright claims. Trademark, privacy, defamation, and other legal complaints should follow the separate process described below.

14. Requirements for a DMCA Takedown Notice

A DMCA copyright-infringement notice must be submitted by the copyright owner or a person authorized to act on the owner’s behalf.

The written notice must include substantially all of the following:

1. A physical or electronic signature of the copyright owner or authorized representative.
2. Identification of the copyrighted work claimed to have been infringed or, when multiple works on one site are involved, a representative list of those works.
3. Identification of the material claimed to be infringing and information reasonably sufficient to allow ETC Montessori to locate it, including the exact URL whenever available.
4. The complaining party’s full name, mailing address, telephone number, and email address.
5. A statement that the complaining party has a good-faith belief that the disputed use is not authorized by the copyright owner, the owner’s agent, or the law.
6. A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is the copyright owner or is authorized to act on the copyright owner’s behalf.

A general description without a specific location or URL may not provide sufficient information to identify the material.

15. ETC Montessori’s Response to a DMCA Notice

After receiving a substantially compliant notice, ETC Montessori may:

• Remove or disable access to the identified material.
• Contact the person or organization that supplied or posted the material.
• Provide the submitting user with a copy of the notice.
• Request additional information from the complaining party.
• Preserve relevant records.
• Take other action reasonably appropriate under applicable law.

ETC Montessori will take reasonable steps to notify the user whose material has been removed or disabled.

A takedown is not a final determination that infringement occurred. ETC Montessori may remove content in good faith while the parties resolve their dispute.

Contact information contained in a notice may be shared with the person who posted the disputed material, legal counsel, service providers, courts, government authorities, or others as reasonably necessary to process the claim.

16. DMCA Counter-Notification

If content was removed or disabled because of a DMCA notice and the person who posted it believes the removal resulted from mistake or misidentification, that person may send a written counter-notification to the designated agent.

A counter-notification must include substantially all of the following:

1. The sender’s physical or electronic signature.
2. Identification of the material removed or disabled and the location where it appeared before removal.
3. A statement under penalty of perjury that the sender has a good-faith belief that the material was removed or disabled because of mistake or misidentification.
4. The sender’s full name, physical address, and telephone number.
5. A statement consenting to the jurisdiction of the appropriate United States Federal District Court for the sender’s address or, if the sender is outside the United States, a federal judicial district where the service provider may be found.
6. A statement agreeing to accept service of process from the person who submitted the original DMCA notice or that person’s agent.

After receiving a substantially compliant counter-notification, ETC Montessori may provide a copy to the original complaining party.

Unless the original complaining party informs ETC Montessori that a court action has been filed seeking to restrain the disputed activity, ETC Montessori may restore the material after the period required by applicable law, generally not fewer than 10 and not more than 14 business days after receipt of the counter-notification.

17. Repeat-Infringer Policy

In appropriate circumstances, ETC Montessori may suspend or terminate the accounts, licenses, purchasing privileges, or website access of users who repeatedly infringe or are repeatedly accused through valid notices of infringing intellectual-property rights.

ETC Montessori may also terminate access for a single serious violation, including large-scale redistribution, resale of unauthorized copies, circumvention of access controls, or deliberate commercial infringement.

ETC Montessori may consider the completeness and validity of notices, counter-notifications, court determinations, user conduct, and other relevant circumstances when applying this policy.

18. Trademark and Other Intellectual-Property Complaints

The DMCA process is limited to copyright claims.

A complaint involving a trademark, service mark, trade dress, patent, right of publicity, or other intellectual-property right should be sent to legal@edutc.com and should include:

• The complainant’s full name and contact information.
• Identification of the right being asserted.
• Registration information, if applicable.
• Evidence of ownership or authorization to act for the owner.
• The exact URL or location of the disputed material.
• A description of why the use is allegedly unlawful.
• A statement that the information provided is accurate.
• A physical or electronic signature.

ETC Montessori may request additional information before evaluating a complaint. Submission of a complaint does not guarantee removal of the disputed content.

19. False or Misleading Notices

Anyone submitting an infringement notice or counter-notification should carefully consider whether the disputed use is authorized by a license, the copyright or trademark owner, fair use, or another legal exception.

Knowingly making a material misrepresentation in a DMCA notice or counter-notification may result in liability for damages, costs, and attorneys’ fees under applicable law.

ETC Montessori reserves the right to seek remedies for fraudulent, abusive, harassing, or knowingly false claims.

20. No Legal Advice

This policy describes ETC Montessori’s intellectual-property practices and complaint procedures. It does not constitute legal advice.

ETC Montessori cannot advise a claimant, customer, user, teacher, school, or other party about whether a particular use is infringing, protected by fair use, or otherwise lawful.

Questions about individual legal rights should be directed to a qualified attorney.

21. Policy Changes

ETC Montessori may revise this policy periodically. Updated terms become effective when posted unless a later date is stated.

Changes to this policy do not expand a previously purchased product license unless ETC Montessori expressly agrees in writing.
